Роль військового омбудсмена у захисті прав військовослужбовців під час збройного конфлікту: міжнародний досвід та українські реалії


Анотація

У статті здійснено аналіз становлення та розвитку інституту військового омбудсмена в Україні в контексті міжнародного досвіду демократичного цивільного контролю над сектором безпеки і оборони. Дослідження базується на порівняльному аналізі моделей військового омбудсмена у Німеччині, Канаді, Австралії, Ірландії та Південно-Африканській Республіці, що дозволило визначити ключові критерії ефективності таких інституцій: рівень інституційної незалежності, обсяг повноважень, механізми парламентської або виконавчої підзвітності та наявність реальних інструментів впливу на усунення порушень прав військовослужбовців. У роботі встановлено, що найбільш результативними є моделі, які функціонують поза прямим впливом виконавчої влади та забезпечують омбудсмену право ініціювати розслідування, проводити інспекції та формулювати обов’язкові або високовпливові рекомендації. Окрему увагу приділено проблемі ефективності консультативних моделей, які, попри формальну наявність механізмів захисту прав військових, часто не забезпечують належного рівня їх практичної реалізації. Проаналізовано процес становлення інституту військового омбудсмена в Україні, який у 2025 році перейшов від законодавчих ініціатив до інституційного оформлення із ухваленням профільного закону та створенням Офісу Військового омбудсмена як допоміжного органу при Президентові України. Водночас доведено, що ключові виклики, визначені на етапі концептуального проєктування інституції, залишаються актуальними, зокрема щодо рівня її незалежності, механізмів реалізації рекомендацій та ефективності реагування на системні порушення прав військовослужбовців. Актуалізація результатів дослідження станом на 2026 рік засвідчила, що запровадження інституту військового омбудсмена підтвердило правильність наукових прогнозів щодо необхідності створення спеціалізованого незалежного механізму захисту прав військовослужбовців. Водночас практична реалізація інституції актуалізувала нові дискусії щодо її місця в системі державної влади та достатності повноважень для забезпечення реального впливу на усунення порушень. Таким чином, дослідження має як теоретичне, так і практичне значення, оскільки дозволяє оцінити еволюцію інституту військового омбудсмена від концептуальної моделі до реального елемента системи демократичного контролю в умовах збройного конфлікту та трансформації сектору безпеки України
