Abstract

Modern jurisprudence is increasingly referring to the philosophical substantiation of social relations and the law as a mechanism for their settlement, but some essential issues – including question of the legal form of social relations, the role of law in regulating and stabilizing social relations – are still the matter and therefore need further discussion. For this reason, the disclosure of the place and role of civil society in the system of modern state formation is an actual direction in the study of the philosophy of law. The article deals with the philosophical and legal aspects of the interaction of institutes of civil society and the rule of law; features of the functioning of the general institutions of the rule of law and civil society are analyzed; interdependence and interdependence of the law and legal consciousness as factors of social regulation of social relations in the state are traced; the principles of formation of legal consciousness in the conditions of legal harmonization of society are researched. The purpose of the article is to trace the evolution and disclose the meaning of the concept of civil society; to carry out scientifically grounded analysis of the influence of civil society on the formation and development of a law-governed state; the emphasis is placed on the fact that civil society stimulates the prerequisites for the construction of a law-governed state, and law-abidingness acts as a principle, a regime and a guarantee of their provision. The author suggests that in the structure of Ukrainian legal reality, modern ideas and values of the rule of law are intended to promote the development of a legal society in accordance with modern legal requirements regarding the protection of human rights and dignity. The study concluded that the problem of legal regulation of social relations in the state is in the field of values of social life, which is characterized by a continuous process of gradual increase in the objective value of legal law. In this sense, an important role for legal socialization of an individual that takes place mainly by fly through of person’s appropriation of the principles of legal consciousness and legal traditions of the culture of society
