Abstract

The article deals with retrospective of analysis and some ways to improve determining criteria and indicators of efficiency of penal institutions in the form of imprisonment. The definitions of "criterion" and “indicator” in relation to determining the effectiveness of the execution of punishment in the form of imprisonment are used as identical. Three positions have been examined in which the origins of a new vision of evaluating the effectiveness of penal institutions in the form of imprisonment are reproduced. An attempt was made to characterize a typical point of view, the essence of which was that the level of effectiveness of institutions in fulfilling the tasks (objectives) that they were facing should be evaluated. The problem, nevertheless, is that there has been no consensus as to what the tasks (functions, objectives) of the agencies activities should be main and real. In the current context of reforming the criminal justice system of Ukraine, this issue is becoming increasingly important and needs urgently to be addressed. The assessment (among other indicators) should be based on the behavior of the convicted person throughout his/her term of isolation from a society. Respectively, it is better to treat corrections as a process that has a specific meaning and impact tools, depending on the stage of serving punishment of staying in isolation. The correctional process is also the individualization of the use of punitive and educational influence on the convicted person, it is also the differentiation and individualization of the use of different forms of stimulating exposure on the behavior of the convicted person (changing conditions of confinement within an institution, transfer to another institution, application of a system of encouragement and discipline, mitigation of punishment, early release from punishment, etc.). This approach reinforces the urgency of more in-depth investigation of the content, nature, characteristics, application forms of progressive system performance (serving) sentence, the ratio of the institute interdisciplinary institutes of differentiation and individualization of punishment, encouraging law behavior while serving their sentence
