Abstract

The article deals with the theoretical and legal study of the principles of the procedural regime of state supervision (control) in the field of activity of the Ministry of Internal Affairs of Ukraine in the context of adaptation of the national legislation to the requirements of the European Union. The analysis of approaches to definition of the general procedural principles of supervision (control) and specialized principles of supervision (control) in the activity of bodies of the Ministry of Internal Affairs of Ukraine and their implementation in practical activity is carried out. Supervision (control), their content is a reflection of the socio-economic and political situation in the country. At each stage of administrative reform, the principles of state supervision (control) absorb the most important progressive ideas needed to reform the system of state supervision (control). It is proved that the administrative and procedural regulation of state supervision (control) in the field of activity of the bodies of the Ministry of Internal Affairs of Ukraine, its current state are characterized by certain negative features that require improvement. The legislation on state supervision (control) consists of a large number of contradictory normative and legal acts and other legal documents, the rules of which include issues that give rise to legal conflicts in the legal field. The imperfection of the current system of principles of state supervision (control), on which the entire system of state supervision (control) is built and operates, does not allow forming an optimal model of the relationship between controlling and controlled entities. The practical implementation of the means of control and supervision is due to the presence of a wide set of discretionary powers of officials of the Ministry of Internal Affairs of Ukraine; as a result, the rights of controlled entities are violated
