Legal Aspects of Classification of Crimes Against Military Security of Ukraine Associated with Section I of the Special Part of the Criminal Code of Ukraine (Crimes Against the Fundamentals of National Security of Ukraine) (Part 1)


Abstract

The purpose of the article is to analyze the legal aspects of the classification of crimes against the military security of Ukraine, which are placed in Section I of the Special part of the Criminal Code of Ukraine, as well as to clarify what bodies of crimes against the fundamentals of national security of Ukraine relate to socially dangerous acts that affect the military security of Ukraine. Scientific novelty. Scientific and theoretical issues related to the legal aspects of the classification of crimes against military security of Ukraine and which are placed in Section I of the Special part of the Criminal Code of Ukraine are investigated. According to the results of the research, it is found out the bodies of crimes against the fundamentals of Ukraine's national security that relate to socially dangerous acts affecting Ukraine's military security. It is emphasized that a common feature that unites crimes affecting Ukraine's military security is that they are committed in favor of a country with which Ukraine is in a state of war, military or other rivalry, or committing a crime creates threats and risks of occurrence of war or armed conflict with another state. Attention is drawn to the fact that crimes affecting Ukraine's military security are detrimental to the protection of state sovereignty, territorial integrity, constitutional order and other vital national interests, since this is directly in line with the definition of military security. The study argues that socially dangerous acts that encroach on the life of a state or public figure or terrorist act are not considered crimes against Ukraine's military security, as they are generally recognized as acts of “political terrorism”. Conclusions. Considering the legal aspects of the classification of crimes against the military security of Ukraine, which are contained in Section I of the Special Part of the Criminal Code of Ukraine (Crimes against the fundamentals of national security of Ukraine), it is proved that the crimes affecting the military security of Ukraine include: treason, sabotage, espionage, obstruction of the lawful activity of the Armed Forces of Ukraine and other military formations
