Abstract

Certain theoretical problems of administrative responsibility for violation of statutory restrictions on receiving gifts were considered. The signs of this corruption-related offense have been investigated. Next features was determined as those that belong to the most significant problems related to liability for violations of statutory restrictions on receiving gifts: lack of clear definition of some concepts which are signs of the analyzed corruption-related offense; difficulty in distinguishing between concepts such as "gift" and "wrongful benefit", and therefore, in distinguishing of the composition of the offense under Art. 1725 CUAO and Art. 368 of the Criminal Code of Ukraine (CCU), and, accordingly, of all types of crime, the subject of which is the wrongful benefit; low level of law enforcement and judicial practice on the declared offense; existence of exceptions to the responsibility for receiving the gift, etc. Certain problems that are still present in the provisions of the administrative legislation regarding the responsibility for violation of statutory restrictions on receiving gifts were identified. Legislative definitions of the concepts that are constructive features of the offense related to the violation of statutory restrictions on the receipt of gifts, as well as theoretical developments in this area were analyzed. This corruption-related offence was compared with the corruption offenses provided in the Criminal Code of Ukraine. Possible options for solving certain problems have been formulated on the basis of the analysis of the current administrative legislation and positions of the doctrine of administrative law. Common and distinctive features of separate concepts of the analyzed offense composition with the related crime offense composition were defined, which allows to define more clearly the boundary between administrative and criminal responsibility for unlawful receipt of material goods by defined subjects
