The Legality of the Police Actions During Administrative Detention


Abstract

Modern society is fundamentally different from previous epochs, because it recognizes the fundamental value of man. In the current context of reforming of all law enforcement agencies on the basis generally recognized principles of the EU Member States, effective administrative and legal regulation and precise, lawful actions of police officers are the pledge to the formation of democratic Ukraine. Although administrative detention is closely linked to the restriction of a person’s right to liberty, police actions must be based on strict compliance with the legal rules regulating the use of this compulsory measure. The application of administrative detention is often connected with the need for the use of special means, which requires police to have a high level of legal and tactical training in order to observe, first, human rights and freedoms, and second, personal security measures. Unfortunately, today there are occasional violations of the right to liberty by police officers during administrative detention and the use of special means
