Abstract
The decision of the local government body is the basis for the acquisition of the right of private property by Ukrainian citizens on land plot in case of the unpaid acquisition of land from communal land. These decisions are often subject to judicial review. Judicial protection is effective if the decision of a court actually affects the achievement of the expected benefit. It depends on how the rights and interests of citizens are protected in disputes arising from the use of discretion by local governments. Effective judicial protection of citizens’ rights in land privatization relations depends on the determination of the legal nature of the discretion of local government bodies in relation to the exercise of the powers of the courts. The purpose of the article is to investigate certain aspects of legal regulation and to determine the prospects of improving the mechanism of free acquisition of land plots by citizens of Ukraine into private property through the powers of local government bodies and to submit proposals to ensure real judicial protection of citizens’ rights. The paper includes such methods of scientific knowledge as structural, functional and method of complex analysis. The scientific novelty of the main results of the study is to determine and carry out an analysis of the main legislative acts concerning legal regulation of the court’s powers when considering the issue of appealing the decision of a local government authority to refuse permission to develop a project of land plots allotment and when considering the issue of appealing the refusal of a local authority government in the transfer of land plots to the property. The legal nature of the powers of the local government body in the case of free transfer of land plots to citizens is determined. In order to ensure effective judicial protection of citizens’ rights to free privatization of land plots, the court should establish at the legislative level the powers of the court to oblige the defendant to take certain actions. Actions must be taken in a manner determined by law, which can protect or restore the infringed right. The judgment must contain a specific injunction to resolve the dispute on the merits. This will make its impact on disputed legal relations real. Courts should evaluate the decisions of local governments and determine whether the activities of these bodies are in conformity with the constitutional special-permitting principle and beyond their powers
