Abstract

The Constitution of Ukraine establishes the levels of legal regulation of social relations, included in the field of intellectual property, in particular: the first level consists of international treaties (which were ratified by the Verkhovna Rada of Ukraine and became part of the national legislation); the second level includes laws; the third level includes other regulations. The national legislation and international legal acts that determine the state policy of the state in the field of intellectual property are considered. The analysis of the entities implementing the state policy in the field mentioned above includes: the Cabinet of Ministers of Ukraine, its subdivisions, local executive authorities, Interstate Council on Legal Protection and Protection of Intellectual Property, Ministry of Internal Affairs of Ukraine, National Police of Ukraine, Security Service of Ukraine, State Fiscal Service of Ukraine, Ministry of Culture of Ukraine, State Agency of Cinema of Ukraine, Antimonopoly Committee of Ukraine, etc. The Concept of reforming the state system of legal protection of intellectual property in Ukraine is analyzed. It is concluded that the formation and implementation of the state policy of the state in the field of intellectual property provides for bringing the current legislation to international norms and standards; creation and development of an effective institutional framework necessary to ensure the acquisition, exercise and protection of intellectual property rights; availability of financial instruments to support innovation and ensure the legal protection and use of intellectual property; cooperation in the field of intellectual property with industry and entrepreneurship, with the academic and university environment, research institutions, mass media, public organizations; strengthening international cooperation and establishing new partnerships for the dynamic development of the National Intellectual Property System and its efficiency
