Historiosophical Aspects of State Intervention in the Human Rights


Abstract

The question of the study of legal boundaries and the extent of state interference with human rights in recent years is all the more demanding. This is most likely due to the mainstream culture of combating discrimination, promoting the principles of equality and justice, increasing the quality of human life as a whole, and progressively striving for the respect to the new researches in this sphere. One of the first pieces of legislation that paid some attention to human rights and freedoms was the Constitution of Lycurgus (7th c. BC), based on the thesis that the well-being of both individuals and the entire state is the result of ethical heights and internal agreement, the harmonious work of society, the cooperation of the individual and the state; The Constitution of Solon (6th c. BC), the so-called Polity, which paid considerable attention to natural human rights; The Constitutions of Andrian and Justinian (117, 534), with a broad list of edicts on civil rights; Shotoku Constitution (604) cultivating the ideas of equality, moderation, justice. In view of the above, it can be affirmed that human rights and freedoms reveal the basic principles of the relationship between the individual and the state. Their implementation depends on the ability of the state to provide and on the readiness of citizens to seek their fulfillment. Thus, the practical aspect of the question concerns a great deal of scientific development, while the theoretical and historical aspects of the problem are: definition, extensive analysis of the results of work, understanding of the thesis, time of use of actual humanitarian experts, alignment in national scientific issues. This article found the states a push for further legal searches in specific areas
