Legislative and Administrative Ensuring of the Functioning of the Collective Gminas in the Second Rzech Pospolita in 1930s (Using the Example of Lviv Povit)


Abstract

The process of legislative ensuring of the establishment of the collective gminas at the beginning of 1930s in the Second Rzech Pospolita is examined. Administrative and legislative features of the establishment are displayed using the example of Lviv povit. The process of the establishment of the collective gminas has overpassed a number of stages. At the first stage the development and the future of gminas as self-governing subdivisions was discussed on the public, political and high-governmental levels. Later, the project of a country gmina reform was transformed into a global reform of the hierarchy of administrative territorial entities of Rzech Pospolita and self-governing state institutions. The bill, which had later become a law, was named “About the partial change of the territorial division” or the Law about a Union and remains this name now. At the second stage, the law-creational process continued. It included the discussion, making changes and voting for the bill on the level of the Senate and Sejm of Rzech Pospolita. It was the adoption of the Law on March 23th 1933 and the signing it by the President, the Head of Government and the Ministers of Internal Affairs, Finance and Social Affairs that ensured the establishment of the collective gminas legislatively. The establishment of the new collective gminas required that the organizational, administrative and normative work should be continued, also at the local (povit) level. As a result, the third stage included the organizational and content-rich work done by local administrative institutions – combining, merging local communities and substantiation of the necessity of these actions made by povit administration, including Lviv povit starostvo. This stage lasted less time than others. The fourth stage became the final one and implied the introduction of the Law into everyday life and its future changes
