Abstract
Limited liability companies and additional liability companies are the most common organizational and legal forms of enterprise in Ukraine. Therefore, this topic is relevant both for citizens and for legal entities in their interest and the availability of property for commercial business and, therefore, for the purpose of profit. The norms regulating the legal regime of the creation and implementation of further activity by economic partnerships, until its termination, were obsolete and required improvements. Therefore, the Law of Ukraine “On Limited Liability Companies and Additional Liability Companies” was adopted; the Law regulates the legal relations of the shareholders of limited liability companies and additional liability companies and eliminates practically all inconsistencies in the legislation concerning the legal regulation of the creation, operation and termination of activity. The purpose of the article is to determine and consider the main aspects of the creation and regulation of business companies under the new law, and to carry out an analysis of innovations in comparison with the provisions of the Law of Ukraine “On Business Companies”. The authors used such methods of scientific knowledge: historical and legal, structural and functional, and the method of complex analysis. The scientific novelty of the main results of the study is thorough considering innovations regarding the legal regulation of the creation, operation and termination of the activity of limited liability companies and additional liability companies and making a comparative analysis of the mentioned norms with the norms of the Law of Ukraine “On Business Companies”. The analysis of the Law of Ukraine “On Limited Liability Companies and Additioal Liability Companies” gives great expectations for the creation and development of business entities, providing a mechanism for preventing their seizure, which is not limited to the above novels, but requires their full interpretation and application
