The Dynamics of the Law-Making Process in the Period of the Ukrainian National Revolution: Age of the Central Council


Abstract

The article deals with the comprehensive analysis of the formation of law at the first stage of the Ukrainian National Revolution of 1917-1921, the priorities of the legislative activity of the Central Council, the successes and failures in the development of the Ukrainian legal system. The scientific analysis of the problem of making the constitutional legislation in terms of building the Ukrainian State is carried out. Peculiarities of the branch legislation are investigated. The legislative activity of the Central Council had two stages in its development. Well-known universals became the main achievement of the first stage, and the establishment of the political and legal line of state building was its main result. At the second stage, which began with the proclamation of the Ukrainian National Republic (UNR), the priority of the legislative activity of the Central Council was to resolve the acute social and other urgent problems in the life of the country, as well as to develop the foundations of the legislative process. The adoption of the Constitution of the UNR – an important political and legal document of the present time, was a major result of the legislative process. The peculiarity of the formation of the branch legislation was the legislator & epos’s reaction to the most acute problems of vital activity of the society and an attempt to regulate them legally. In the field of state building, the issues of elections and national autonomy, citizenship were regulated by law; in the field of legal support for economic reform, the issues of the state budget, the development of the financial and agrarian system were solved. Some steps were taken by the Central Council in the field of labor and criminal law, education and science
